摘 要：我国虽然已经建立了编辑责任制,但由于缺乏配套性法律规定,我国编辑的法律地位与权利义务尚不明确,难以保障编辑责任制的真正落实。从现有的法律规范体系来看,我国编辑权利义务配置主要存在三个方面的问题:编辑法律地位不明确,立法中混同编辑权利义务与出版单位权利义务,编辑法定权利存在规范"空白"。对此,应当在立法上进一步明确编辑的法律地位,重点回应上述三个方面的问题,并坚持权利义务的一致性原则,赋予编辑履行法定职责所需的相应的权利内容,实现编辑权利义务的对等化配置,从而加强编辑的职业保障,推动出版事业持续、稳定地发展。

Abstract: Although the editorial responsibility system has been established in China, the legal status and rights and obligations of editors in China are still unclear due to the lack of supporting legal provisions, which makes it difficult to ensure the true implementation of the editorial responsibility system. From the perspective of the existing legal standard system, there are mainly three problems in the arrangement of rights and obligations of editors in China: the unclear legal status of editors, the confusion between rights and obligations of editors and the rights and obligations of publishing units in legislation, and the "blank" of legal rights of editors. In this regard, we should further clarify the legal status of editors in legislation, focus on responding to three aspects of the problem in legislation, and adhere to the principle of consistency of rights and obligations, in legislation, give editors the corresponding rights required to perform their statutory duties, so as to achieve the equal allocation of rights and obligations of editors. So as to strengthen the professional security of editors and promote the sustainable and stable development of publishing.
