摘 要：上海等地出现的地方国家权力机关授权立法活动，是地方立法实践回应现实需求的新探索。地方立法权属于地方人大及其常委会的职权，与中央立法权是同源出于主权的国家权力。地方立法权由地方国家权力机关掌握，可依靠自身之意志行使、处分,因此,地方人大及其常委会应具有授权立法的能力，可以作出授权立法。地方国家权力机构授权立法虽然具备优势,但仍需警惕其泛滥带来的不良影响，应当将相应制度纳入统一的法制轨道，正式确立并加以监督。

Essay: The authorized legislation of local state power organs: Problems and motivations

Abstract: The local state power organs authorized legislative activities in Shanghai and other places, is a new exploration of local legislation practice to respond to the needs of the reality. The local legislative power belongs to the local people's Congress and its Standing Committee of the central authority, legislative power and sovereign state power is homologous. Local legislative power by the local state power organs, can rely on their own will to exercise, therefore, the local people's Congress and its Standing Committee should have the ability to authorize legislation. Although the authorized legislation of local state power institutions has advantages, but still need to be wary of the adverse effects. The corresponding system should be incorporated into a unified legal system to establish and supervise the legal system.
