摘 要 编制立法规划是立法行为之一。立法规划具有法的性质，即立法规划属于一种立法性质的文件，具有法的约束力，但它又有别于典型意义上的法，是一种特殊意义的法，表现在其编制主体、编制程序以及效力的特殊性，具有"软约束"的特点。立法规划兼具有指令性和指导性双重属性。基于立法规划作用的有限性以及立法规划存在的"体制性障碍"等原因，强化立法规划成为必要。强化立法规划必须加强规则与制度的建设。编制立法规划，除了坚持立法的一般原则外，还需要坚持需要、合法与可行三项基本原则，以提高立法的及时性、针对性和系统性，树立所立法之法的权威性。健全编制立法规划的体制和机制、完善立法项目的论证制度是保证立法规划的合宪性、正当性以及有效性的重要路径。

Abstract: Making legislative plans is one of the legislative acts. The legislative plan has the nature of law, that is, the legislative plan is a kind of legislative document and has the binding force of the law. But it is different from law in a typical sense. It is a special kind of law with the specialty of subject, procedure and effectiveness, which has the characteristics of "soft constraints". Legislative planning has both directive and guiding attributes. Due to the limited role of legislative planning and the "systemic obstacles" in legislative planning, it is necessary to strengthen legislative planning. Strengthening legislative planning must strengthen the construction of rules and systems. For formulating a legislative plan, in addition to adhering to the general principles of legislation, it is also necessary to adhere to the three basic principles of need, legality, and feasibility in order to improve the timeliness, pertinence, and systematism of legislation. In this way, the authority of legislation can be established. Improving the system and mechanism for the preparation of legislative plans and the system for demonstrating legislative projects are important ways to ensure the constitutionality, legitimacy, and effectiveness of legislative plans.
