摘 要：社会主义核心价值观融入司法裁判主要有两个方面的路径:在一般性情形中,社会主义核心价值观能够通过确立裁判的价值取向,补强裁判文书的事理、情理、法理,优化裁判文书的说理技巧。在疑难案件中,社会主义核心价值观作为裁判的指引,能够为道德裁判提供明确的方向,为价值冲突提供清晰的位阶,为公共政策引入司法提供便捷的途径。其中,作为裁判的说理性引入,社会主义核心价值观在法律论证中充当了论证的"起点",并通过过错关联、因果关系关联与公共利益关联三种关联论证策略证成司法裁决。作为裁判的指引性引入,社会主义核心价值观通过正当化个人期望、正当化强制力来源构建起司法裁判的说服力标准与约束力标准,为裁判观点的选择提供明确的指引。

Essay: Socialistic Core Value Absorbs into Judgment: The Ways and Methods

Abstract: The absorption of socialist core values into judgment mainly contains two ways: In general cases, socialist core values can establishing the value orientation of the judgment and strengthen the reasons, affection and jurisprudence of the judgment to optimize the reasoning skills of the judgment. In difficult cases, socialist core values can provide a clear direction for moral judgment, a clear level for value conflicts, and provide a convenient way for public policies to draw into judgment. Thereinto, as the introduction of the reasoning of judgment, socialist core values serve as the "starting point" of legal argumentation, and the judicial verdict is proved by three related argumentation strategies: fault correlation, causality correlation and public interest correlation. As the guiding introduction of the judgment, the socialist core values construct the persuasive and binding standards of the judgment through the legitimation of individual expectations and the source of coercive force, to provide clear guidance for the choice of the view of the judgment.
